Writ filed at SC demanding PM seek vote of confidence

The petition comes after the Janata Samajbadi Party (JSP) withdrew its support to the government on July 16, 2025. According to Article 100 of Nepal’s Constitution, the prime minister must table a vote of confidence within 30 days of a coalition partner withdrawing support.

KATHMANDU, Aug 21: Advocate Birendra KC on Thursday filed a writ petition at the Supreme Court (SC) demanding that Prime Minister KP Sharma Oli be ordered to seek a vote of confidence in Parliament.



The petition comes after the Janata Samajbadi Party (JSP) withdrew its support to the government on July 16, 2025. According to Article 100 of Nepal’s Constitution, the prime minister must table a vote of confidence within 30 days of a coalition partner withdrawing support. Failure to secure a majority would result in removal from office.

Advocate KC named Prime Minister Oli, the Office of the Prime Minister and Council of Ministers, Speaker Devraj Ghimire, the Federal Parliament Secretariat, and the Office of the President as defendants in the case.


The petition argues that since more than a month has passed without the PM seeking a vote of confidence, a constitutional breach has occurred.
