SC upholds HC judges’ appointment

KATHMANDU, April 13: The Supreme Court on Friday upheld the appointment of high court judges two years ago. 



A five-member constitutional bench comprising of Chief Justice Cholendra SJB Rana and justices Deepak Kumar Karki, Kedar Prasad Chalise, Meera Khadka and Hari Krishna Karki upheld the appointment.

A writ petition was filed at the apex court claiming that the appointment was made at midnight in violation of the constitutional and legal norms. 


The appointment was criticized even by the members of the Judicial Council, the judges' appointing authority.


Advocate Toyanath Dhungana and Deputy Attorney General Durga Bandhu Pokhrel had challenged the appointment in the apex court citing procedural error of the appointment due to the absence of two members of the Judicial Council—then senior-most justice Vaidhyanath Upadhyaya and Ram Prasad Sitaula.
