President Paudel authenticates citizenship amendment bill

Children of Nepali women and foreign fathers may obtain citizenship by descent or naturalization

KATHMANDU, Sep 21: President Ram Chandra Paudel has authenticated the bill related to citizenship on Sunday.



According to the Office of the President, the bill—passed by the (now dissolved) Federal Parliament and National Assembly and submitted for authentication — has been authenticated in accordance with Article 113 (2) of the Constitution of Nepal, 2015.


The bill amends the Citizenship Act of 2006, introducing provisions to address citizenship rights for children born to Nepali women married to foreign nationals.

Under the amended Act, a child born to a Nepali female citizen through marriage with a foreign national and residing permanently in Nepal may be granted naturalized citizenship, as prescribed by law, provided that the child has not acquired foreign citizenship through the father.


In cases of citizenship by descent, the Act requires the mother’s declaration affirming that the child has not obtained foreign citizenship based on the father's nationality.


Additionally, a child may be eligible to acquire citizenship in the mother's name if the father is deceased, has abandoned the child, refuses to support the citizenship process, or is married to another person.


The amendment also complies with the Supreme Court’s directive to the government, which instructed the state to ensure the right to citizenship through the mother’s lineage.
